Terms of Sale

1. Publisher

The Pickaxe Gems mobile application is published by:

2. Purpose

These terms of sale govern in-app purchases made within the Pickaxe Gems mobile application. By making a purchase, you accept these terms in their entirety.

3. Products and prices

The products offered for sale are virtual gem packs, a virtual currency used within the Pickaxe Gems application.

• Gems are a virtual currency with no real-world value, non-exchangeable and non-refundable except as provided by the withdrawal right
• Prices are displayed inclusive of all taxes within the application, set by the publisher and subject to change
• VAT: VAT exemption under franchise (Article 293 B of the French General Tax Code) or applicable VAT depending on the publisher’s current tax regime

4. Order process

In-app purchases are made through Google Play Billing. Google acts as the intermediary (merchant of record).

1. The player selects a gem pack in the application’s shop
2. The player confirms their consent to immediate delivery and waiver of the withdrawal right
3. The player validates the purchase through the Google Play interface and receives a confirmation receipt

5. Payment

Payment is handled entirely by Google Play (credit card, Google Pay and other methods accepted by Google). The publisher does not collect or store any payment data.

6. Right of withdrawal

In accordance with the French Consumer Code:

• The consumer has a 14-day withdrawal right from the date of purchase (Art. L221-18)
• Before gem delivery, the player gives express consent to immediate execution of the digital content and acknowledges waiving the right of withdrawal (Art. L221-28, 13°)
• Gems credited after explicit consent are non-refundable

Refund requests may also be submitted directly to Google Play, whose refund policy applies in parallel.

7. Digital conformity guarantee

In accordance with Articles L217-1 et seq. of the French Consumer Code, digital content provided must conform to its description and be functional. In the event of a conformity defect, the player may request that the content be brought into conformity within two years of delivery.

8. Nature of gems and liability

Virtual gems are subject to the following conditions:

• They have no monetary value outside the application
• They are non-transferable between accounts or players
• They may be lost in the event of account deletion or permanent game shutdown, with no right to compensation

9. Consumer mediation

In accordance with Article L612-1 of the French Consumer Code, in the event of an unresolved dispute with customer service, the consumer may freely resort to a consumer mediator. The designated mediator will be communicated at a later date.

10. Assignment and transfer

These terms of sale may be assigned or transferred by the publisher to any entity that succeeds it in operating the application, including in the event of a change in legal form or transfer of business. Such transfer shall not affect the consumer’s rights. The player will be notified of any change of publisher via in-app notification.

11. Changes to terms

These terms of sale may be modified at any time. Changes affecting consumer rights take effect 30 days after notification by email and in-app. Purchases made before the effective date remain subject to the terms accepted at the time of purchase. By continuing to make purchases after this period, you accept the modified terms.

12. Governing law

These terms are governed by French law. Any dispute relating to their interpretation or execution falls under the jurisdiction of the courts of Lyon, France.
