1. Publisher

The Pickaxe Gems mobile application is published by:

2. Purpose

These terms of use govern the use of the Pickaxe Gems mobile application. By using the application, you accept these terms in their entirety. In-app purchases are governed by separate terms of sale.

3. Registration and account

Using Pickaxe Gems requires creating an account (email address and password). Each person may only hold one account. The player is responsible for the confidentiality of their login credentials.

4. Personal data and consent

Personal data processing is described in the Pickaxe Gems privacy policy. The application distinguishes between data required for the service (collected without specific consent) and analytics data (collected only with the player’s explicit consent).

5. In-app purchases

In-app purchases are governed by the Pickaxe Gems terms of sale.

6. Advertising

The application displays ads via Google AdMob. Ad frequency decreases progressively based on the player’s activity in the shop.

7. Conduct

The following are prohibited: cheating, reverse engineering, exploiting bugs, score manipulation and any behavior aimed at altering the normal functioning of the game. Any abuse may result in the suspension or permanent deletion of the account.

8. Intellectual property

All application content — source code, design, graphic assets, music, sound effects — is the exclusive property of Mathieu Corne / Opale Games. Any unauthorized reproduction, modification or distribution is prohibited.

9. Limitation of liability

The game is provided “as is”, with no guarantee of permanent availability. Opale Games shall not be held liable for any loss of progress due to technical incidents.

10. Assignment and transfer

These terms of use may be assigned or transferred by the publisher to any entity that succeeds it in operating the application, including in the event of a change in legal form or transfer of business. Such transfer shall not affect the player’s rights. The player will be notified of any change of publisher via in-app notification.

11. Changes to terms

These terms may be modified at any time. Changes take effect 15 days after publication. Major changes will be notified via in-app notification. By continuing to use the application after this period, you accept the modified terms.

12. Governing law

These terms are governed by French law. Any dispute relating to their interpretation or execution falls under the jurisdiction of the courts of Lyon, France.
